Who Can Be Sponsored?

You may sponsor your partner if the relationship is genuine and meets one of the following categories:

  • Spouse – A legally recognized marriage, valid both in the country of marriage and in Canada
  • Common-Law Partner – Couples who have lived together continuously for at least 12 months
  • Conjugal Partner – Partners in a committed relationship who cannot live together due to serious legal or immigration barriers

Spousal Sponsorship

This category applies to couples who are legally married. Canada recognizes both opposite-sex and same-sex marriages, provided the marriage is legally valid.

Sponsors must prove the authenticity of the relationship through documentation such as marriage certificates, communication records, and shared responsibilities.

Common-Law Partner Sponsorship

Inland vs Outland Sponsorship

Outland Sponsorship

Inland Sponsorship

For partners already living in Canada. This option allows couples to remain together during processing and may include eligibility for an open work permit.

Applicants Without Legal Status in Canada

Canada has a public policy that allows spouses and common-law partners living in Canada without legal status to apply for permanent residence. This policy reflects Canada’s strong commitment to family unity and humanitarian considerations.

Sponsor Eligibility Requirements

To sponsor a spouse or partner, the sponsor must:

  • Be at least 18 years old
  • Be a Canadian citizen or permanent resident
  • Reside in Canada (or plan to return if a citizen living abroad)
  • Demonstrate the ability to financially support the sponsored person
  • Not be under a removal order, bankrupt, incarcerated, or convicted of serious offences

In most cases, there is no minimum income requirement, unless dependents are involved.

  • Prove the relationship is genuine and not entered into for immigration purposes
